The Australian Securities and Investments Commission (ASIC) has conducted a comprehensive review of the motor vehicle finance sector, uncovering significant issues related to lender oversight and consumer protection.
The findings reveal instances of high loan establishment fees and inadequate monitoring of car finance distributors.

ASIC Commissioner Alan Kirkland highlighted cases where loan establishment fees reached as high as $9,000 on a $49,000 loan. Additionally, nearly half of consumers who defaulted on their car finance repayments did so within the first six months of the loan term. Alarmingly, of the vehicles that were repossessed and sold, almost 90% of consumers still owed more than half of their original loan amount.

These statistics raise concerns about whether consumers are being granted loans they cannot afford to repay, aligning with themes in complaints that prompted the review. The Consumer Action Law Centre welcomed ASIC's preliminary findings, emphasizing the detrimental impact of high-cost loans and inadequate lender oversight on consumers.

Stephanie Tonkin, CEO of the Consumer Action Law Centre, noted that car finance sold at the point of sale often traps consumers in unaffordable debt for vehicles that may be faulty. This situation results in consumers facing both financial stress and the burden of owning unreliable vehicles.

In response to these findings, ASIC is expected to implement measures to enhance lender accountability and protect consumers from predatory lending practices. Prospective borrowers are advised to exercise caution when considering vehicle financing options. It's crucial to thoroughly review loan terms, compare offers from multiple lenders, and seek independent financial advice to ensure the loan is affordable and suitable for their financial situation.
